Terms and Conditions

RENTAL BALANCE:
A deposit is required within 3 days of making a reservation, depending on your arrival date. Final payment is due 60 days prior to your arrival date. Final payment for all HOLIDAY bookings (Christmas and New Years) is due 90 days before arrival. For last-minute bookings (arrivals within 60 days of reservation date), FULL PAYMENT is due within 3 days. Failure to pay on time will result in automatic cancellation of the reservation and forfeiture of all monies paid to date.

CHECK-IN AND CHECK-OUT TIME:
Plan to arrive at your villa no earlier than 3:00 PM. Do not use the villa or premises before this time. We make every effort to ensure your villa is ready by 3:00 PM but cannot guarantee this. Check-out time is 11:00 AM. Please vacate the villa no later than 11:00 AM to allow for cleaning and preparation for the next guests.

OCCUPANCY:
Guest agrees not to exceed the occupancy allowed by the property as described in this Rental Agreement (infants 1 year or under are not included, maximum 2 free per rental). LocoGringo does not rent to minors. Penalties for violations are outlined in Paragraph 4.

PENALTY FOR VIOLATION OF THIS AGREEMENT:
If Guest violates any of the terms of this Agreement, LocoGringo or the property Manager may terminate this Agreement and enter the villa. Upon termination, Guest and their invitees must vacate the property immediately and will not be entitled to any refund.

US VILLA ACCIDENTAL DAMAGE FEE:
An Accidental Damage Plan is required and due with the balance payment. This plan covers accidental damages exceeding normal wear and tear (up to $1,000; normal wear and tear is considered up to $50). Any damages beyond this amount will be charged to the Guest. Damage caused by abuse, negligence, or malicious behavior will be charged in full to the Guest, including any excess cleaning fees or attorney’s fees.

INDEMNIFICATION OF AGENT BY GUEST:
Guest agrees to indemnify and hold harmless LocoGringo, its employees, agents, and managers from any claim, liability, or damage arising from their rental, including personal injury or property damage to Guest or their invitees.

LEASEHOLDER RESPONSIBILITIES:
Only the individual who reserved the property will be held responsible for payment and any other responsibilities associated with the rental.

RATES, ACCOMMODATION SUBSTITUTION AND AMENITIES:
All rates, services, and amenities are subject to change without notice. LocoGringo reserves the right to substitute similar services, accommodations, or amenities due to availability issues or clerical errors. All prices are in U.S. Dollars.

REPAIRS / CONSTRUCTION:
Occasional malfunctions may occur. LocoGringo and property owners employ the best available managers and maintenance crews to address issues promptly. Entry into the villa by staff for maintenance is permitted during business hours. Refunds are not issued for equipment failure or construction noise. LocoGringo properties are in a developing resort area, and construction may occur nearby.

PETS:
Pets are not allowed in the villas.

PROPERTY AVAILABILITY:
In cases where the property becomes unavailable due to natural disasters or major unexpected repairs, LocoGringo will attempt to find alternate accommodations. If this is not possible, guests may reschedule within 12 months in the same season (or pay the difference in seasonal rate). Travel insurance is recommended to cover such scenarios.

CHEF SERVICES:
Chef services, if desired, must be arranged exclusively through LocoGringo. Outside chef/cook services are not permitted.

CANCELLATION / RESCHEDULE POLICY:

Cancellations
All payments are non-refundable and non-transferable unless LocoGringo can re-rent the same property for the same rate and dates, subject to a $200 cancellation fee. Cancellations made 30 days or fewer before arrival are 100% non-refundable.

Rescheduling / Changes
You may reschedule at least 30 days before your arrival date, keeping the same property and length of stay, for travel within 12 months of the original check-out date. A $50 rescheduling fee applies. Reschedules are subject to availability and price changes. One reschedule allowed per reservation. Changes to guest count must be made before final payment and are subject to a $50 change fee.

Note: If only part of your reservation is re-rented, you may receive a partial refund (less the $200 cancellation fee) or reschedule the full stay as noted above. No refunds for extra person charges canceled less than 15 days before arrival.

Cancellations Due to Pandemics or World Emergencies
Rescheduling within 12 months is allowed (excluding holidays and high-demand weeks), one time only. No refunds will be issued for switching to a lower rate season. Rescheduling under 30 days before arrival is reviewed case-by-case with documentation.

NO REFUNDS FOR EARLY CHECK-OUTS OR NO SHOWS:
Guests who check out early or fail to show up for their reservation forfeit all payments made.

HURRICANE EVACUATION / CANCELLATION POLICY:
No refunds for weather-related issues or evacuations. If a property becomes uninhabitable due to hurricane damage, LocoGringo may cancel the reservation and offer a 12-month reschedule window in the same season (or at a higher rate if different season). Travel insurance is recommended. No refunds for sargassum/seaweed on beaches, as this is a natural event beyond our control.

PERSONAL PROPERTY / VALUABLES:
Each property includes a safe. Guests are advised to secure all valuables and always lock doors and windows, even while on the property. LocoGringo and the property owners are not responsible for lost or stolen items. Lost items may be returned upon request for a shipping fee ($100–$200) plus a $50 handling fee.

AMENITIES:
LocoGringo will not issue refunds for unavailable or non-functioning amenities, including Internet or satellite TV, which are provided by third parties and not guaranteed.

OWNERS CLOSETS:
Some areas of the villa may be locked and reserved for the Owner’s personal use.

PROHIBITED VEHICLES:
Street parking is not allowed. The communities prohibit campers, motorhomes, motorcycles, boats, trailers, and recreational vehicles.

SMOKING AND ILLEGAL DRUGS:
Smoking inside villas is prohibited. Possession or use of illegal drugs will result in immediate eviction with no refund.

USE OF PROPERTY:
All non-residential use (e.g., weddings, events, photoshoots) must be approved in writing by LocoGringo. Event fees and deposits may apply. Misrepresenting such events will result in forfeiture of deposit and possible eviction. Guests must respect noise ordinances and end all music and loud activities by 10 PM. DJ “rave” parties are not permitted and will result in eviction with no refund. LocoGringo is not liable for noise disturbances from neighboring properties.

HOMES / VILLAS:
LocoGringo acts solely as the rental agent for villa owners and is not responsible for furnishing additional items not included with the property. Guests are responsible for returning furniture to its original location if moved.

INTERNATIONAL TRAVEL DOCUMENTATION:
U.S. citizens must present a valid passport to enter Mexico. Minors traveling alone or with one parent require a notarized letter of consent. Other nationalities should check with the Mexican Consulate for travel requirements. No refunds for lack of proper documentation.

VILLA DOCUMENTS:
Check-in instructions, directions, and other necessary documents will be emailed after receipt of Final Payment, the Accidental Damage Fee, and written confirmation that Guest agrees to the Rental Terms.

VENUE IN CASE OF DISPUTE:
By booking with LocoGringo, you agree that any legal disputes will be resolved in Mexico.
