Damage and Security Deposit

A $1,000.00 security deposit is required, and must be paid directly to the owner 60 days prior to arrival in the form of a check in US Dollars. After checkout the villa will be cleaned and a thorough inventory taken before the next guests check in. Provided there is no more than reasonable clean up and nothing damaged or missing, then a check for the returned security deposit will be mailed to you within 3 working days. It is understood that with the exception of the items mentioned within this agreement, all other damages or lost items will be deducted at replacement cost, which may include but is not limited to labor expense, shipping and importation costs. Locked pantries and closets are reserved for the use of the villa owner and are not included in this rental. You as the guest agree to take all reasonable steps to ensure that your family and other guests in your party adhere to the rules and regulations affecting the villa. Guests are responsible for the villa, its contents, and themselves during occupancy. Guests must lock villa's windows and doors securely when not on the premises, and must observe all cautions, as given in the villa ‘Guest Book’ or from the villa Owners or their staff. The villa is privately owned, so décor, colours and inventories may change. Rearranging the furniture, using the couches and pillows as beds, or removing any items from the villa is prohibited. It is further understood that smoking inside the villa or exceeding the maximum occupancy will forfeit the security deposit.

Cancellations
  • The rental deposit, less a $500.00 cancellation fee is refundable until 90 days prior to the arrival date.
  • Cancellations between 61-90 days of arrival are subject to a 50% surcharge of the rental.
  • Cancellations between 31-60 days of arrival are subject to a 75% surcharge of the rental.
  • Cancellations less than 30 days of arrival are subject to a 100% surcharge of the rental.
  • Bookings for Christmas and New Year are subject to 100% surcharge regardless of time of cancellation.
In the event of a cancellation we will try to recover your money by rebooking the dates. If we feel it necessary, we will discount the rates in an effort to rebook the dates. Should we be successful at rebooking, then we will refund you the difference between your original booking price and the total of what we have collected, less a $500 cancellation fee. 100% of security deposit will be refunded upon any cancellation. Smoking: Smoking is permitted on the terraces, rooftop and around the pool. No smoking is allowed inside the villa. Smoking within the villa will automatically forfeit the security deposit.

Maximum Occupancy: Maximum occupancy, including children, is 2 people per room rented. Written exception may be given for babies sleeping in cribs. Exceeding this limit will automatically forfeit the security deposit. Couches and cushions are not to be used as beds.

Registered Guests: Only registered guests are allowed inside the villa and on the property. Permission of the Property Administrator must be obtained for any non-registered access.

Quiet Enjoyment & Parties: We wish to maintain a family atmosphere for the quiet enjoyment of our villa and property for our guests. We rent to family groups and responsible adults only. Absolutely NO house parties or functions such as weddings are allowed without advance WRITTEN permission from the owners. Guests shall be sufficiently quiet and peaceful, so as not to disturb other residents in the neighborhood.

Weddings & Special Events: Brisa Caribe is a popular location for weddings, anniversaries, family reunions and other special events. While we welcome most of these events, sometimes these events can result in additional wear, tear, consumption and exposure to breakage and loss. Therefore for all special events that involve non registered guests and/or catering staff entering the property, WRITTEN permission from the owners is required. Please provide details as to the type of function you wish to have. The number of registered guests, non registered guests and catering staff who will be attending. What other events or activities are planned at the villa during the week, which involve non-registered guests or catering staff entering the property? This information will help us to assess whether we will approve the event being held at the villa and if so, the appropriate charges.

Check in - Check out Time: Check in is after 3:00 P.M. and check out is before 11:00 A.M. Arrangements can be made for secure storage of luggage should you require it.

Entry into the Villa: The villa owners, or their staff, may enter the villa to perform any repairs or maintenance as necessary. If the villa is put on the market for sale, the villa owner reserves the right to allow the villa to be shown, but only by advance appointment made with guests. Every effort will be made to schedule such brief showings at a time convenient to you, to respect your privacy, and not interrupt your vacation.

Questions, Complaints & Maintenance: The villa owners and their staff work hard to ensure that the villa and amenities are in place and in good working order. The owner or their administrator will be available to handle questions, complaints and supervise villa maintenance. In case of a maintenance problem, the villa owner or administrator will strive to have the problem repaired as soon as possible after being notified. However, no refund or rate adjustment shall be made for unforeseen failures such as the supply of electricity, water, pool filtration systems, air conditioning, telephone, television or satellite service, appliances, etc. It is guest's obligation to report any problems or damage IMMEDIATELY to the owner or administrator.

Electronic Safes & Keys: There is a $75 charge for lost villa keys to replace the locks on the villa doors.

Bicycles: There is a $200 charge for a lost bicycle and a $15 charge for a lost lock or key.

Satellite TV: Please do not reprogram the satellite TV system or disconnect wiring to TV, VCR or stereo. If you do and then we have to have it reprogrammed, there will be a $50 charge.

Cellular telephone: If the cellular telephone is lost or damaged, there will be a $150 charge to replace it. There will be no refund for any time still credited to the telephone upon checkout.

Responsibility: The renter named in this agreement will be responsible for themselves and all guests whether they are registered in the villa or not. The renter acknowledges that Brisa Caribe, its owners, employees, and agents do not carry personal liability insurance and can not be held responsible regardless of fault, for any accident, loss, damage or injury suffered by the renter, members of their party or any other guests which the renter or their party have allowed access to the property, regardless if said loss is a result directly or indirectly from acts of god, danger incident to the sea, any body of water, fire, breakdown of machinery, equipment, acts of government or other authorities, de jure or de facto, wars (whether declared or not), hostilities, civil disturbances, strikes, riots, thefts, pilferage, epidemics, quarantines, custom regulations, delays or cancellations of or changes in itineraries or schedule or from acts of omission of any airline. Furthermore, the renter will release and hold harmless any and all parties involved with the rental, management and reservations of the property and to release and hold harmless it's owners or representatives for any loss or damage to personal property or for any injury and/or death.
